1. Acceptance of Terms

By accessing or using MomTeach ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MomTeach.

2. Service Description

MomTeach is an AI-powered educational platform that enables families to create personalized learning experiences using voice cloning and avatar technology. Our Service includes:

• AI voice cloning technology to replicate family members' voices
• Avatar creation using family photos
• Personalized curriculum for Primary 1-6 (P1-P6) students
• Interactive lesson delivery through AI avatars
• Progress tracking and analytics
• "Bring Your Own Book" (BYOB) feature for custom curriculum

Pre-Launch Notice: MomTeach is currently in pre-launch phase. Features may change, and early access terms apply to waitlist members.

3. Eligibility

3.1 Age Requirements

You must be at least 18 years old to create an account and use MomTeach. Our Service is designed for adult users (parents, guardians, educators) to create learning experiences for children.

3.2 Parental Consent

By using MomTeach, you represent and warrant that:

• You are the parent or legal guardian of any child for whom you create content
• You have the legal authority to consent to your child's use of the Service
• You will supervise your child's use of the Platform
• You consent to the collection and use of your child's data as described in our Privacy Policy

3.3 Geographic Restrictions

MomTeach is available worldwide. However, certain features may be restricted based on local laws and regulations.

4. Account Registration

4.1 Account Creation

To use MomTeach, you must create an account by providing:

• Valid email address
• Full name
• Secure password
• Payment information (for paid subscriptions)

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Using strong, unique passwords

4.3 Account Accuracy

You agree to provide accurate, current, and complete information and to update it as necessary to maintain its accuracy.

5. Subscription & Payment

5.1 Subscription Plans

MomTeach offers the following subscription tiers:

Each additional family avatar (beyond the first) costs the same as your base subscription plan. Example: Pro plan ($129/month) + 1 additional avatar = $258/month total.

5.3 Billing & Payment

• Billing Cycle: Monthly subscriptions are billed on the date you subscribe
• Auto-Renewal: Subscriptions automatically renew unless canceled
• Payment Methods: Credit card, debit card, or other accepted methods
• Currency: All prices are in USD unless otherwise specified
• Taxes: You are responsible for applicable taxes

5.4 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Changes do not affect current billing cycles.

5.5 Early Bird Discount

Waitlist members who subscribe during the launch period receive a 50% lifetime discount. This discount:

• Applies for the lifetime of the subscription
• Remains valid as long as the subscription is not canceled
• May not be transferred or combined with other offers

5.6 Refund Policy

• 14-Day Money-Back Guarantee: Full refund if canceled within 14 days of first subscription
• No Partial Refunds: No refunds for partial months or unused services
• Cancellation: Cancel anytime; service continues until end of billing period
• Refund Processing: Refunds processed within 5-10 business days

5.7 Failed Payments

If payment fails:

• We will attempt to charge your payment method up to 3 times
• Your account may be suspended after failed payment attempts
• Reinstate by updating payment information within 7 days
• Accounts not reinstated within 30 days may be terminated

6. User Content & Voice Data

6.1 Your Content

"Your Content" includes:

• Voice recordings you upload or create
• Photos used for avatar creation
• Custom curriculum materials (BYOB feature)
• Progress data and usage information

6.2 Content Ownership

You retain all ownership rights to Your Content. By uploading content, you grant MomTeach a limited, worldwide, non-exclusive, royalty-free license to:

• Process and store your voice recordings
• Generate AI voice clones for your account
• Create and display avatars based on your photos
• Process curriculum materials for lesson creation
• Provide and improve the Service

6.3 Voice Cloning Rights

By uploading voice recordings, you represent and warrant that:

• You own or have permission to use the voice
• The voice belongs to you or a family member who has consented
• You will not clone voices without proper authorization
• You understand AI voice clones are for family educational use only

6.4 Content Restrictions

You agree NOT to upload or create content that:

• Violates intellectual property rights
• Contains harmful, offensive, or inappropriate material
• Includes voices of individuals without their consent
• Violates any applicable laws or regulations
• Contains viruses, malware, or malicious code

6.5 Content Storage & Deletion

• Storage Duration: Content stored while subscription is active
• Deletion Upon Cancellation: Content deleted 30 days after subscription ends
• Backup Responsibility: You are responsible for backing up important content
• Right to Delete: You may request content deletion at any time

6.6 BYOB Content

For "Bring Your Own Book" content:

• You must own or have permission to use uploaded materials
• Copyright responsibility lies with you
• We are not liable for copyright infringement
• We may remove content if copyright violations are reported

7. Acceptable Use

7.1 Permitted Use

MomTeach is intended for:

• Personal, family educational purposes
• Creating learning experiences for your children
• Homeschooling and supplemental education
• School use (with appropriate licensing)

7.2 Prohibited Activities

You agree NOT to:

• Use the Service for commercial purposes without authorization
• Share, resell, or distribute AI-generated content outside your family
• Reverse engineer, decompile, or extract source code
• Create voice clones for fraudulent purposes
• Attempt to breach security or access unauthorized areas
• Use automated systems (bots) to access the Service
• Impersonate others or create fake accounts
• Upload viruses or malicious code
• Abuse, harass, or harm other users
• Violate any laws or regulations

7.3 Enforcement

We reserve the right to:

• Investigate violations of these Terms
• Suspend or terminate accounts that violate Terms
• Remove content that violates Terms
• Report illegal activity to authorities
• Take legal action against violators

8. Intellectual Property

8.1 MomTeach Property

All rights, title, and interest in MomTeach, including but not limited to:

• Software, code, and algorithms
• AI models and voice cloning technology
• Avatar generation systems
• User interface and design
• Trademarks, logos, and branding
• Curriculum content (non-BYOB)

...are owned by MomTeach and protected by intellectual property laws.

8.2 Trademarks

"MomTeach," the MomTeach logo, and related marks are trademarks of MomTeach. You may not use our trademarks without prior written permission.

8.3 Copyright

All content provided by MomTeach is protected by copyright. You may not copy, reproduce, distribute, or create derivative works without authorization.

8.4 DMCA Compliance

We respect intellectual property rights. If you believe your copyright has been infringed, contact us with:

• Description of copyrighted work
• Location of infringing material
• Your contact information
• Statement of good faith belief
• Statement of accuracy under penalty of perjury

9. Privacy & Data Protection

• Photos for avatar creation

9.4 Data Retention

• Account data: Retained while subscription is active
• Voice and photo data: Deleted 30 days after cancellation

• Billing records: Retained for 7 years (legal requirement)

10. Children's Privacy (COPPA Compliance)

10.1 COPPA Compliance

MomTeach complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without verifiable parental consent.

10.2 Parental Consent

By creating an account, you (the parent/guardian) consent to:

• Show advertisements to children
• Track children for behavioral advertising
• Share children's data with third parties for marketing
• Use children's data for any purpose beyond educational services

11. Termination

11.1 Termination by You

You may cancel your subscription at any time through:

Cancellation takes effect at the end of your current billing period.

11.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• Payment fails and is not resolved within 30 days
• You engage in fraudulent activity
• Required by law
• You abuse or misuse the Service

11.3 Effect of Termination

Upon termination:

• Access to the Service is immediately revoked
• Your Content is deleted after 30 days
• No refunds for unused subscription time (except 14-day guarantee)
• Outstanding payments remain due
• Provisions that should survive (IP, liability, etc.) remain in effect

12. Disclaimers

12.1 "As Is" Service

MomTeach is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

12.2 Educational Disclaimer

MomTeach is a supplemental educational tool. We do not guarantee:

• Academic improvement or specific learning outcomes
• Compliance with specific school curricula
• Suitability for all learning styles or needs
• Replacement for qualified educators

12.3 AI Technology Disclaimer

AI voice cloning and avatar technology may:

• Produce imperfect or unnatural results
• Not perfectly replicate human voices or expressions
• Occasionally produce errors in pronunciation or content
• Require multiple attempts to achieve desired quality

12.4 Third-Party Content

BYOB content uploaded by users is not reviewed or endorsed by MomTeach. We are not responsible for accuracy, quality, or legality of user-uploaded content.

12.5 Availability

We do not guarantee:

• 24/7 availability of the Service
• Uninterrupted access
• Freedom from bugs or errors
• Compatibility with all devices or browsers

13. Limitation of Liability

13.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMTEACH'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MOMTEACH IN THE 12 MONTHS PRECEDING THE CLAIM.

13.2 Exclusion of Damages

MOMTEACH SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Loss of goodwill or reputation
• Emotional distress
• Punitive or exemplary damages

13.3 Basis of the Bargain

These limitations reflect the allocation of risk between you and MomTeach. The Service pricing reflects these risk allocations and limitations.

13.4 Jurisdictional Limitations

Some jurisdictions do not allow limitation of implied warranties or liability for incidental damages. In such jurisdictions, liability is limited to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless MomTeach, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Violation of these Terms
• Violation of any third-party rights (intellectual property, privacy, etc.)
• Your Content (voice recordings, photos, BYOB materials)
• Any fraudulent or illegal activity
• Claims by third parties related to your use of the Service

15. Changes to Terms

15.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be effective:

• Upon posting to our website
• After notice to you via email (for material changes)
• After 30 days for significant changes affecting your rights

15.2 Notification

For material changes, we will:

• Send email notification to your registered email
• Display prominent notice on the Platform
• Provide a summary of key changes

15.3 Acceptance

Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service and cancel your subscription.

MomTeach is not liable for delays or failures caused by circumstances beyond reasonable control (natural disasters, wars, pandemics, government actions, etc.).

17.6 Survival

Provisions that by their nature should survive termination (IP, liability, indemnification, etc.) shall survive.

17.7 Language

These Terms are provided in English. Any translations are for convenience only; English version controls in case of conflicts.
